California Senator Margett Seeking to Curb Growing Tide of Elder Abuse Cases

SACRAMENTO - Senator Bob Margett (R-Glendora) announced the introduction of SB 1259 and that he is co-authoring AB 1999 by Assemblyman Anthony Adams. Both of these measures seek to limit the growing trend of elder abuse cases in California.
SB 1259, sponsored by the California District Attorney’s Association, would make the intentional exploitation of a senior citizen’s physical, mental, or psychological state in order to take possession of his or her assets a criminal offense. Under current law, theft by undue influence of an elder is only punishable via a civil lawsuit.
“Elder abuse is a serious problem in California that has devastating consequences for both senior citizens and their families,” said Senator Margett. “SB 1259 would help alleviate some of those problems by giving District Attorneys the chance to prosecute those who prey on vulnerable elders.”
AB 1999, a measure introduced by Assemblyman Adams and co-authored by Senator Margett, would require an Ombudsman to be present whenever a long-term care facility receives a gift or bequest from a resident of the facility.
“AB 1999 is a win-win for both long term-care facilities and their residents,” stated Senator Margett. “A CEO’s, executive’s, or a care-giver’s job is directly related to the bottom line of the facility and there is the potential for these individuals to pressure residents into donating money. Having an Ombudsman present will create a better sense that financial gifts are given legitimately and protect residents against the occasional bad actor.”
