State Revokes License For Elderly Care Residential Facility

The California Department of Social Services (CDSS) has revoked the license and ordered the closure of Madonna Maria residential care facility for the elderly in San Marcos, due to serious violations impacting the health and safety of its residents. This action is based on several substantiated violations cited by CDSS’ Community Care Licensing Division and the failure of licensed operators, Josie and Herminio Velazquez, to timely appeal the decision. The closure will take effect today March 27th. The facility was licensed for up to six elderly residents.
An investigation by CDSS uncovered violations that included the death of a client suffering from dementia who was allowed to wander unnoticed from the facility, failure of the licensees to provide appropriate care for clients who suffered fractures and pressure sores while in the facility, failure to maintain adequate client records, failure to ensure that staff underwent legally-mandated background checks, and operating the facility over the maximum capacity. Additionally, Josie and Herminio Velazquez were found to have aided and abetted their daughter in operating an unlicensed elder care facility.
Due to the seriousness and pervasiveness of the violations, the action taken by CDSS also permanently excludes both licensees from working in any licensed Community Care facility.
